Caloorie Terms of Service

These Terms of Service ("Terms") govern your use of the Caloorie mobile application and related services ("Services"). Caloorie is developed and operated by Namadosoft ("Company", "we", "us", or "our"), based in İzmir, Turkey. By downloading, accessing, or using our app, you agree to these Terms. If you do not agree to the Terms, please do not use the app.
1. Scope of Services and Medical Disclaimer
Informational Use: Caloorie is a tracking and informational tool designed to help you analyze the calories and nutritional values of the food you eat.
Not Medical Advice: No information provided within the app is a substitute for the advice, diagnosis, or treatment of a dietitian, doctor, or authorized health professional. Always consult a specialist before making any decisions regarding your health condition, diet, or nutritional habits. Namadosoft cannot be held liable for any health issues arising from the use of Caloorie.
2. Account Creation and Security
You must create an account to utilize all features of our Services.
You are obligated to provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your account and password. You are directly responsible for all activities that occur under your account.
If you notice any unauthorized access to your account, you must notify us immediately.
3. Free Trial Period and Subscriptions
Caloorie does not offer a permanent free basic version to users; instead, it operates on a full-access trial period followed by a subscription model.
10-Day Free Trial: New users are granted a 10-day free full access right starting from the moment they create an account, allowing them to experience all features of the app.
Subscription Requirement: Once the 10-day free trial period expires, you must choose a paid subscription plan to continue using the app. If a subscription is not initiated, your access to the services will be restricted.
Billing: Subscription transactions and in-app purchases are processed through the Apple App Store or Google Play Store using the respective platform's payment systems.
Auto-Renewal: Subscriptions automatically renew at the end of the current billing cycle unless canceled.
Cancellations: You must process subscription cancellations directly through your device's app store settings (App Store or Google Play). Deleting the app does not automatically cancel your subscription. In case of cancellation, you will continue to have access to the features until the end of the current billing cycle.
4. Fair Use Policy and Daily AI Usage Limits
Caloorie's food analysis features (photo analysis, text analysis, meal suggestions, and motivational messages) and AI reports are powered by artificial intelligence services that incur a processing cost per request. To keep the Services sustainable, fast, and fairly available to all users, the following fair use limits apply:
Daily Limits: Each account is subject to a daily usage limit of 50 AI analysis requests (covering photo analysis, text analysis, meal suggestions, and motivational messages combined) and 5 AI reports per calendar day. These limits apply equally to all accounts, including trial users and paid subscribers.
Limit Reset: Daily limits reset automatically at the start of each new calendar day.
Usage Counter: Your current daily usage is displayed within the app in your profile settings, so you can track how many requests you have used and how many remain for the day.
When a Limit Is Reached: Once a daily limit is reached, the related AI features become temporarily unavailable until the limit resets. All other app features (viewing your logs, history, statistics, and manually recorded entries) remain fully accessible.
Enforcement: Usage limits are enforced on our servers on a per-account basis. Attempting to circumvent these limits (including through automated tools, multiple accounts, or manipulation of the app) constitutes a violation of these Terms and may result in suspension or termination of your account.
Changes to Limits: We may adjust these limits from time to time to reflect operational costs and service quality. Material changes will be reflected in these Terms and, where significant, announced within the app in accordance with Section 8.
5. User Conduct and Prohibitions
By using the app, you agree in advance not to engage in the following actions:
Uploading any software, viruses, or malicious code that would prevent, disrupt, or slow down the operation of the app.
Attempting to copy, crack, or decipher the source code of the app through reverse engineering.
Using the Services for illegal, fraudulent, or unauthorized purposes.
Attempting to gain unauthorized access to other users' accounts.
Circumventing or attempting to circumvent the fair use limits described in Section 4, including by creating multiple accounts or using automated tools.
6. Intellectual Property Rights
All rights, titles, software codes, algorithms, logos, designs, and content of the Caloorie app belong to Namadosoft. These Terms do not transfer the ownership of the app or its content to you. You are granted a limited, revocable, non-transferable, and non-exclusive right to use the app solely for personal, non-commercial purposes.
7. Limitation of Liability
Caloorie is provided on an "as is" and "as available" basis. We do not guarantee that the Services will be uninterrupted, error-free, or entirely secure. The nutritional and calorie analyses within the app rely on database matches and image recognition algorithms; the 100% accuracy of this data cannot be guaranteed. To the maximum extent permitted by law, our Company cannot be held liable for any direct, indirect, incidental, or punitive damages arising from the use of the app.
8. Changes to the Terms
We reserve the right to update these Terms of Service at any time without prior notice. When changes are made, the "Last Updated Date" will be revised, and significant changes will be announced to you via notifications in the app. Your continued use of the app after the changes are published constitutes your acceptance of the updated terms.
9. Governing Law and Jurisdiction
The laws of the Republic of Turkey shall apply in the implementation, interpretation of these Terms, and the resolution of any legal disputes arising under these Terms. The Courts and Execution Offices of İzmir have exclusive jurisdiction in the event of any dispute.
